ASSAULT & ATTEMPTED MURDER
CHARGES DISMISSED
Drug Charges Sustained:
Our Client, Koy B., was charged
with Assaulting and Attempting to Murder a family on their front porch. The
man and woman who lived there called the police during the fight. When the
police arrived residents and their grown daughter explained how our guy (who
was now gone) had attacked them and they did have scratches and bruises. The
grown daughter said she came up and witnessed the fight and stated our guy
ran away while they were calling the police. The police located our guy at
his house down the street and found drugs on him which he never denied
having. The family ID'd our guy and the police took him away.
Our guy could not afford an attorney but was
fortunate to get a really good, young, aggressive attorney not so prone to
take an appointed case and 'plead it out'. He asked the Judge for funds to
hire a private investigator and they were approved. We interviewed our guy
in the Harris County Jail immediately, but that was still 6-weeks after his
arrest. His story was that the grown daughter was a friend of his that he
had argued with about drugs. When he went to her house to talk to her again,
her family attacked him and beat him up. He still had severe bruising on his
arms and legs from where they had hit him with a 2x4 board.
We got permission from the Court and came back
later and took photos documenting his injuries. We also talked to neighbors
who supported his story. After a second interview with the daughter, she
recanted. We took a recorded statement and the attorney presented it with
our report and photos to the Prosecutor. He pled out on the drug charge for
probation and the Assault & Attempted Murder charges were dismissed 5 1/2
months after his arrest.

ACCUSATION OF SEXUAL ASSAULT:
Our Client Joe D., was charged with sexually assaulting his 14 year old
daughter; twelve years later. The daughter, now 26 had been living in
Chicago since she was 14 and came to Harris County in 2007 and told the
police about the incident. They found a CPS file from 1995 and took the file
and the daughter's current statement to the DA who took the charges.
Our Client hired an excellent attorney who asked us to look into the case.
Our investigation revealed that the 14-year old girl had only been with her
father a short time before making the accusation in 2007 to CPS. Her
mother had sent her to Harris County (from Chicago) in 1995 because she had
become unruly. Our Client tried to control her behavior and her wild antics.
He tried grounding her and other disciplinary methods that also did not
work. She called CPS in 1995 and said that he had molested her. The CPS
investigation was determined unfounded and he sent her back to her mother in
Chicago.
In the next twelve years she had given birth to a son and been arrested
numerous times. Family members had passed her from one to another because of
her behavioral problems. She came to Harris County in 2007 because she was
fleeing an assault charge on her own son. When she arrived on the father's
doorstep, he called Chicago and found out 'why' she was here and told her
she could not stay with him. For revenge on being rejected, she called the
police and got the old charges looked at again. The officers and the DA did
not have "the rest of the story" in the beginning. But when the full story
was presented to the Grand Jury, our Client was NO BILLED and all charges
were dropped.
